Kim Davis: Kentucky Clerk Who Refused Marriage Licenses Violated Open Records Act

FRANKFORT, Ky. (AP) - The Kentucky lawyer general's office says an eastern Kentucky region assistant who made news when she declined to issue marriage licenses to same-sex couples a year ago has disregarded the state's Open Records Act.

In a conclusion discharged Tuesday, the lawyer general's office said Rowan County Clerk Kim Davis abused the Open Records Act by declining to deliver archives identified with the marriage fight.

The Lexington Herald-Leader said the Washington philanthropic Campaign for Accountability on March 1 asked for records amongst Davis and Liberty Counsel, yet Liberty Counsel declined to agree. It refered to lawful exceptions including that the reports are preparatory and are private as opposed to open.

The Campaign for Accountability spoke to the lawyer general, whose decisions on the Open Records Act convey the weight of law in Kentucky.
